Honestamente nem sei se havia lugar a qualquer indemniza&amp;ccedil;&amp;atilde;o pois tal conceito n&amp;atilde;o se cola com a minha postura. Existem demasiadas escolas a funcionar como pequenos feudos, onde o poder &amp;eacute; absoluto e descamba nos atropelos mais elementares de equidade quer de funcion&amp;aacute;rios, quer de alunos, quer de professores, sendo que o ensino deveria ser para todos, tendo como dado adquirido que &amp;eacute;: por todos! Quando as institui&amp;ccedil;&amp;otilde;es que formam, demonstram pelas m&amp;aacute;s pr&amp;aacute;ticas que &amp;eacute; poss&amp;iacute;vel vencer, subir ou obter benef&amp;iacute;cios atrav&amp;eacute;s de posturas vazias dos mais elementares valores julgo n&amp;atilde;o nos podermos queixar de termos pol&amp;iacute;ticos deformados, sociedades &amp;ldquo;coisificadas&amp;rdquo; FUNDAMENTA&amp;Ccedil;&amp;Atilde;O&lt;/font&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;strong&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;II.2 De direito&lt;/font&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;E certo &amp;eacute; que, tendo a Lei 3/2008 sido publicada no dia 18 de Janeiro, a mesma entrou em vigor no 5&amp;ordm; dia ap&amp;oacute;s publica&amp;ccedil;&amp;atilde;o, ou seja, no dia 23 de Janeiro de 2008, &amp;agrave; luz do disposto no n&amp;ordm; 2 do art. 2&amp;ordm; da &lt;a href="http://dre.pt/pdf1sdip/1998/11/261A00/61306134.pdf" title="Lei n&amp;ordm; 74/98" target="_blank"&gt;Lei n&amp;ordm; 74/98, de 11 de Novembro&lt;/a&gt;.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Em conclus&amp;atilde;o: A condena&amp;ccedil;&amp;atilde;o da arguida em medida disciplinar sancionat&amp;oacute;ria, &amp;agrave; revelia do regime legal aplic&amp;aacute;vel, na medida acabada de expor, com viola&amp;ccedil;&amp;atilde;o das normas supra identificadas e transcritas, consubstanciando viola&amp;ccedil;&amp;atilde;o dos mais elementares direitos de audi&amp;ecirc;ncia e de defesa da aluna.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Entre outros, no ac&amp;oacute;rd&amp;atilde;o do Supremo Tribunal Administrativo, de 31-10-2006, proferido no &lt;a href="http://www.dgsi.pt/jsta.nsf/35fbbbf22e1bb1e680256f8e003ea931/83318a8ac2ca3e5e8025722d0054cf0e?OpenDocument" title="Processo 01276/05" target="_blank"&gt;processo 01276/05&lt;/a&gt;, decidiu-se o seguinte:&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;&amp;ldquo;&lt;em&gt;Perante o que h&amp;aacute; que reconhecer que a acusa&amp;ccedil;&amp;atilde;o, ao contr&amp;aacute;rio do que exige o citado art. 59 ED, n&amp;atilde;o explicita, com precis&amp;atilde;o e clareza, os factos disciplinarmente il&amp;iacute;citos que imputa &amp;agrave; arguida, bem como as circunst&amp;acirc;ncias de tempo, modo e lugar da pr&amp;aacute;tica de tais factos, integradores da infrac&amp;ccedil;&amp;atilde;o disciplinar que lhe foi atribu&amp;iacute;da e pela qual veio a ser punida.&lt;/em&gt;&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;em&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Assim sendo, ficou a arguida sem conhecimento perfeito dos factos de que era acusada, e, por isso, impossibilitada de se defender da respectiva imputa&amp;ccedil;&amp;atilde;o, contraditando ou justificando esses factos. sido ignor&amp;acirc;ncia ou m&amp;aacute; interpreta&amp;ccedil;&amp;atilde;o da lei?&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Em qualquer caso, tal como disp&amp;otilde;e o art&amp;ordm; 6&amp;ordm; do &lt;a href="http://www.portolegal.com/CodigoCivil.html" title="C&amp;Oacute;DIGO CIVIL" target="_blank"&gt;C&amp;oacute;digo Civil&lt;/a&gt;, &lt;em&gt;A ignor&amp;acirc;ncia ou m&amp;aacute; interpreta&amp;ccedil;&amp;atilde;o da lei n&amp;atilde;o justifica a falta do seu cumprimento nem isenta as pessoas das san&amp;ccedil;&amp;otilde;es nela estabelecidas&lt;/em&gt;.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Certo &amp;eacute; que o R&amp;eacute;u carreia agora uma tese justificativa da sua posi&amp;ccedil;&amp;atilde;o que passa pelo seguinte, em s&amp;iacute;ntese:&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Invoca o disposto no art&amp;ordm; 2&amp;ordm; da Lei 3/2008 e no n&amp;ordm; 3 do art&amp;ordm; 24&amp;ordm; da Lei n&amp;ordm; 30/2002 e d&amp;aacute; relevo (com sublinhado) ao segmento final desta norma, ou seja, &lt;em&gt;as medidas correctivas e medidas disciplinares sancionat&amp;oacute;rias, devem ser aplicadas em coer&amp;ecirc;ncia com as necessidades educativas do aluno (&amp;hellip;) &lt;u&gt;e nos termos do &lt;a href="http://sol.sapo.pt/blogs/xptopbl/archive/2008/07/01/ESCOLA-SECUND_C100_RIA-DE-POMBAL-_2D00_-REGULAMENTO-INTERNO-_1320_-CAP_CD00_TULO-VIII.aspx" title="REGULAMENTO INTERNO CAP&amp;Iacute;TULO VIII" target="_blank"&gt;respectivo regulamento&lt;/a&gt;&lt;/u&gt;&lt;/em&gt;.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;font size="3"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;E conclui o R&amp;eacute;u: &lt;/span&gt;&lt;span style="font-family:'Times New Roman','serif';"&gt;&amp;ldquo;Assim, parece-nos l&amp;iacute;quido que, enquanto n&amp;atilde;o se procedesse &amp;agrave; adapta&amp;ccedil;&amp;atilde;o prescrita na norma transit&amp;oacute;ria, durante tal per&amp;iacute;odo transit&amp;oacute;rio, continuava a aplicar-se o previsto nos Regulamentos Internos em vigor, ou seja, aprovados &amp;agrave; luz da Lei 30/2002.&amp;rdquo;&lt;/span&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;.&lt;/span&gt;&lt;/font&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Em erro, todavia.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Em lado algum se vislumbra norma que suspenda temporariamente, condicione ou transfira para outro momento ou data a entrada em vigor da Lei n&amp;ordm; 3/2008 ou fixe &lt;em&gt;vacatio legis&lt;/em&gt; espec&amp;iacute;fica.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Ademais, &amp;eacute; a pr&amp;oacute;pria Lei n&amp;ordm; 3/2008, no seu art&amp;ordm; 2&amp;ordm;, que ordena que os regulamentos internos das escolas sejam adaptados ao que nela (Lei n&amp;ordm; 3/2008) se estatui.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;E n&amp;atilde;o o contr&amp;aacute;rio.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;E enquanto n&amp;atilde;o forem adaptados os regulamentos, o que acontece &amp;agrave;s normas regulamentares que contrariem a lei?&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;A resposta afigura-se simples: &amp;Agrave; FUNDAMENTA&amp;Ccedil;&amp;Atilde;O&lt;/font&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="margin:0cm 0cm 10pt;"&gt;&lt;strong&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;II.2 De direito&lt;/font&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;(&amp;hellip;)&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;No concreto processo disciplinar em crise, o que se passou do ponto de vista procedimental e jus-substantivo?&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Simplesmente n&amp;atilde;o foram observadas as disposi&amp;ccedil;&amp;otilde;es normativas constantes dos n&amp;ordm;s 2, 3, 4, 5 e 6 do referido art&amp;ordm; 43&amp;ordm;.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Sen&amp;atilde;o vejamos:&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Embora a medida disciplinar que prevaleceu aplicada &amp;agrave; arguida &amp;ndash; a de transfer&amp;ecirc;ncia de escola &amp;ndash; seja da compet&amp;ecirc;ncia do respectivo director regional de educa&amp;ccedil;&amp;atilde;o, num primeiro momento foi aplicada a medida disciplinar de expuls&amp;atilde;o, por acto do Conselho de Turma Disciplinar, seguindo-se as vicissitudes supra descritas em sede de recurso hier&amp;aacute;rquico e actos subsequentes.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;&amp;Eacute; de notar que a medida de expuls&amp;atilde;o nem sequer fazia parte do elenco das medidas disciplinares sancionat&amp;oacute;rias constantes do art&amp;ordm; 27&amp;ordm; da lei n&amp;ordm; 30/2002, pois havia sido expressamente revogada pelo art&amp;ordm; 1&amp;ordm; da Lei 3/2008.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Certo &amp;eacute; que, prosseguindo o processo disciplinar, n&amp;atilde;o foi produzida acusa&amp;ccedil;&amp;atilde;o formal contra a arguida.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;O que implicou n&amp;atilde;o ter a arguida sido notificada de uma acusa&amp;ccedil;&amp;atilde;o, nem ter tido a oportunidade de se defender duma acusa&amp;ccedil;&amp;atilde;o, por inexistente.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;A arguida foi, na fase inicial do processo disciplinar, ouvida em declara&amp;ccedil;&amp;otilde;es, sendo que a respectiva acta apenas revela que &amp;ldquo;&amp;agrave; mat&amp;eacute;ria dos autos&amp;rdquo; a arguida, disse, declarou, o que da acta consta e nada mais.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;E, de seguida, v&amp;ecirc;-se confrontada com uma decis&amp;atilde;o de aplica&amp;ccedil;&amp;atilde;o de uma medida disciplinar sancionat&amp;oacute;ria de expuls&amp;atilde;o, a qual, ap&amp;oacute;s recurso hier&amp;aacute;rquico, veio a ser modificada para passar a ser uma medida disciplinar sancionat&amp;oacute;ria de transfer&amp;ecirc;ncia de escola.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Na verdade, o R&amp;eacute;u ignorou completamente o regime introduzido pelas altera&amp;ccedil;&amp;otilde;es decorrentes do Lei n&amp;ordm; 3/2008, designadamente o disposto no referido art&amp;ordm; 43&amp;ordm;, tendo aplicado apenas o anterior regime, o constante da vers&amp;atilde;o origin&amp;aacute;ria (Lei n&amp;ordm; 3/2008), designadamente o disposto no art&amp;ordm; 46&amp;ordm;.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="margin:0cm 0cm 10pt;"&gt;&lt;strong&gt;&lt;span style="line-height:115%;font-family:'Arial','sans-serif';color:red;font-size:14pt;"&gt;Ter&amp;aacute; viola&amp;ccedil;&amp;atilde;o das regras do procedimento disciplinar.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Em s&amp;iacute;ntese, alega a Autora que o processo disciplinar n&amp;atilde;o observou o disposto no art&amp;ordm; 43&amp;ordm; da &lt;a href="http://dre.pt/pdf1sdip/2002/12/294A00/79427951.pdf" title="Lei n&amp;ordm; 30/2002, de 20 de Dezembro" target="_blank"&gt;Lei n&amp;ordm; 30/2002, de 20 de Dezembro&lt;/a&gt;, na redac&amp;ccedil;&amp;atilde;o introduzida pela &lt;a href="http://min-edu.pt/np3content/?newsId=1570&amp;amp;fileName=lei_3_2008.pdf" title="Lei n&amp;ordm; 3/2008, de 18 de Janeiro" target="_blank"&gt;Lei n&amp;ordm; 3/2008, de 18 de Janeiro&lt;/a&gt;, designadamente quanto &amp;agrave; dedu&amp;ccedil;&amp;atilde;o de acusa&amp;ccedil;&amp;atilde;o e sua notifica&amp;ccedil;&amp;atilde;o &amp;agrave; aluna arguida.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;O R&amp;eacute;u manifestou-se amplamente e sintetizou, englobando este aspecto, em conclus&amp;atilde;o o seguinte:&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Times New Roman','serif';"&gt;&lt;font size="3"&gt;&amp;ldquo;a) &amp;ndash; Em todo este processo a Escola foi transparente,&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Times New Roman','serif';"&gt;&lt;font size="3"&gt;b) &amp;ndash; A aluna, aqui Demandante, foi ouvida,&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Times New Roman','serif';"&gt;&lt;font size="3"&gt;c) &amp;ndash; Foi tida em considera&amp;ccedil;&amp;atilde;o a proposta apresentada pela Aluna em sede de recurso hier&amp;aacute;rquico,&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Times New Roman','serif';"&gt;&lt;font size="3"&gt;d) &amp;ndash; Assim a Aluna participou activamente no processo de tomada de decis&amp;atilde;o e;&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Times New Roman','serif';"&gt;&lt;font size="3"&gt;e) &amp;ndash; S&amp;oacute; n&amp;atilde;o foi aplicada a medida preconizada pela Aluna porquanto, salvo o devido respeito que &amp;eacute; sempre muito, esta n&amp;atilde;o aceitou o que recomendou&amp;rdquo;.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Vejamos.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;O processo disciplinar no &amp;acirc;mbito do qual foram proferidas as decis&amp;otilde;es colocadas em crise nesta ac&amp;ccedil;&amp;atilde;o impugnat&amp;oacute;ria iniciou-se com base num facto ocorrido no dia 8 de Fevereiro de 2008, data do &lt;a href="http://sol.sapo.pt/blogs/xptopbl/archive/2008/06/22/08_2D00_02_2D00_2008-O-MAIL_2E002E002E00_-.aspx" title="O MAIL" target="_blank"&gt;e-mail de den&amp;uacute;ncia&lt;/a&gt; supra identificado no probat&amp;oacute;rio.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;A essa data estava em pleno vigor o Estatuto do Aluno do Ensino N&amp;atilde;o Superior aprovado pela Lei n&amp;ordm; 30/2002, de 20 de Dezembro, com as altera&amp;ccedil;&amp;otilde;es introduzidas pela Lei n&amp;ordm; 3/2008, de 18 de Janeiro.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;&lt;font size="3"&gt;Sob a ep&amp;iacute;grafe &amp;ldquo;&lt;em&gt;Compet&amp;ecirc;ncias disciplinares e tramita&amp;ccedil;&amp;atilde;o processual&lt;/em&gt;&amp;rdquo; A Autora e ali arguida &lt;a href="http://xptopbl.blogs.sapo.pt/13539.html" target="_blank"&gt;tomou conhecimento&lt;/a&gt; das propostas de pena disciplinar referidas, no dia 21-05-2008, dando-se por reproduzido o integral teor de fls.108 a 115 do processo disciplinar;&lt;/span&gt;&lt;/font&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;font size="3"&gt;&lt;strong&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;N)&lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt; No processo disciplinar n&amp;ordm; 15/2008, no qual foi arguida (&amp;hellip;), aluna da escola Secund&amp;aacute;ria com 3&amp;ordm; Ciclo do Ensino B&amp;aacute;sico de Pombal, n&amp;atilde;o foi deduzida acusa&amp;ccedil;&amp;atilde;o formal contra a arguida;&lt;/span&gt;&lt;/font&gt;&lt;/p&gt;&lt;p class="MsoNormal" style="text-align:justify;margin:0cm 0cm 10pt;"&gt;&lt;font size="3"&gt;&lt;strong&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt;Q)&lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:'Arial','sans-serif';"&gt; O estudo diz que os gastos das fam&amp;iacute;lias portuguesas em 2005 com o Ensino Superior correspondiam a 11% do PIB per capita nacional e quantifica o custo m&amp;eacute;dio anual total da frequ&amp;ecirc;ncia no ensino p&amp;uacute;blico em 5310 euros. E se for no privado, a situa&amp;ccedil;&amp;atilde;o ainda &amp;eacute; mais dif&amp;iacute;cil, j&amp;aacute; que o custo sobe 53%. &lt;/span&gt;&lt;/p&gt;&lt;p style="margin:0cm 0cm 6pt;line-height:150%;"&gt;&lt;span style="font-size:9pt;color:black;line-height:150%;font-family:'Arial','sans-serif';"&gt;Comparando com outras realidades na Europa, torna-se mais vis&amp;iacute;vel a disparidade no esfor&amp;ccedil;o financeiro dos portugueses que conseguem entrar nas universidades. Pagamos dez vezes mais que na Finl&amp;acirc;ndia, quase o qu&amp;aacute;druplo do que gastam belgas, irlandeses e suecos, e o dobro dos franceses. &lt;/span&gt;&lt;/p&gt;&lt;p style="margin:0cm 0cm 6pt;line-height:150%;"&gt;&lt;span style="font-size:9pt;color:black;line-height:150%;font-family:'Arial','sans-serif';"&gt;A situa&amp;ccedil;&amp;atilde;o torna-se ainda mais grave se entrarem nas contas desta balan&amp;ccedil;a o apoio social escolar para quem frequenta o Ensino Superior em Portugal. Os apoios nem chegam a cobrir um quinto das despesas, uma situa&amp;ccedil;&amp;atilde;o que s&amp;oacute; &amp;eacute; pior na It&amp;aacute;lia e na Irlanda. &lt;/span&gt;&lt;/p&gt;&lt;p style="margin:0cm 0cm 6pt;line-height:150%;"&gt;&lt;span style="font-size:9pt;color:black;line-height:150%;font-family:'Arial','sans-serif';"&gt;O risco desta combina&amp;ccedil;&amp;atilde;o de factores afastar as fam&amp;iacute;lias pobres da frequ&amp;ecirc;ncia universit&amp;aacute;ria &amp;eacute; bem real. No inqu&amp;eacute;rito que deu origem ao estudo, mais de 90% dos inquiridos pertenciam a agregados familiares com rendimentos m&amp;eacute;dios e altos, tendo a autora notado que &amp;quot;os pais dos universit&amp;aacute;rios t&amp;ecirc;m habilita&amp;ccedil;&amp;otilde;es significativamente mais elevadas do que o do conjunto da popula&amp;ccedil;&amp;atilde;o portuguesa com idade an&amp;aacute;loga&amp;quot;.&lt;/span&gt;&lt;/p&gt;&lt;p style="margin:0cm 0cm 6pt;line-height:150%;"&gt;&lt;span style="font-size:9pt;color:black;line-height:150%;font-family:'Arial','sans-serif';"&gt;O aumento de 452% no valor das propinas entre 1995 e 2005 ajuda a explicar as dificuldades no acesso a um curso superior para as fam&amp;iacute;lias pobres. O nome deste modelo ainda est&amp;aacute; em segredo e os respons&amp;aacute;veis recusam assumi-lo como uma vers&amp;atilde;o 2.0.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p style="margin:0cm 0cm 6pt;text-align:justify;"&gt;&lt;span style="font-family:Arial;"&gt;&lt;font size="3"&gt;&amp;laquo;Vamos chamar-lhe apenas Magalh&amp;atilde;es&amp;raquo;, disse Jo&amp;atilde;o Paulo S&amp;aacute; Couto, administrador da empresa, em confer&amp;ecirc;ncia de imprensa que serviu para apresentar este novo modelo e tamb&amp;eacute;m para revelar os resultados semestrais da JP S&amp;aacute; Couto. De acordo com os n&amp;uacute;meros divulgados, a empresa facturou 165 milh&amp;otilde;es de euros em 2008 dos quais 14,5 correspondem ao neg&amp;oacute;cio do Magalh&amp;atilde;es. &lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p style="margin:0cm 0cm 6pt;text-align:justify;"&gt;&lt;span style="font-family:Arial;"&gt;&lt;font size="3"&gt;Para este ano, j&amp;aacute; com a produ&amp;ccedil;&amp;atilde;o do novo modelo, a JP S&amp;aacute; Couto prev&amp;ecirc; uma factura&amp;ccedil;&amp;atilde;o de 600 milh&amp;otilde;es de euros dos quais 400 milh&amp;otilde;es derivam do Magalh&amp;atilde;es. O investimento para este ano ronda os 30 milh&amp;otilde;es de euros tendo a empresa aumentado a capacidade de produ&amp;ccedil;&amp;atilde;o para 2,7 milh&amp;otilde;es de unidades.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p style="margin:0cm 0cm 6pt;text-align:justify;"&gt;&lt;span style="font-family:Arial;"&gt;&lt;font size="3"&gt;O novo Magalh&amp;atilde;es, do qual apenas foi poss&amp;iacute;vel ver algumas fotografias, dirige-se ao mesmo p&amp;uacute;blico-alvo. &amp;laquo;Dirige-se &amp;agrave; mesma faixa et&amp;aacute;ria do actual Magalh&amp;atilde;es e os dois modelos v&amp;atilde;o co-habitar no mercado&amp;raquo; real&amp;ccedil;a Jo&amp;atilde;o Paulo S&amp;aacute; Couto ao recusar que o novo modelo vem substituir o actual.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p style="margin:0cm 0cm 6pt;text-align:justify;"&gt;&lt;span style="font-family:Arial;"&gt;&lt;font size="3"&gt;O Novo Magalh&amp;atilde;es &amp;ndash; o &amp;uacute;nico nome pelo qual &amp;eacute; conhecido o computador apresentado &amp;ndash; vai incluir mais espa&amp;ccedil;o em disco e traz incorporada a caneta de escrita que no actual &amp;eacute; vendida em separado. Disp&amp;otilde;e de um &amp;eacute;cr&amp;atilde; de 10.1&amp;rdquo;, disponibiliza uma sa&amp;iacute;da VGA, que permite fazer a liga&amp;ccedil;&amp;atilde;o do port&amp;aacute;til a um monitor de TV, possui uma ranhura interna para liga&amp;ccedil;&amp;atilde;o 3G/Wimax e possui um software de leitura que permite trabalhar mesmo em ambientes com muita luz.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p style="margin:0cm 0cm 6pt;text-align:justify;"&gt;&lt;span style="font-family:Arial;"&gt;&lt;font size="3"&gt;A Venezuela, com a previs&amp;atilde;o de entrega de um milh&amp;atilde;o de unidades do Magalh&amp;atilde;es, &amp;eacute; o primeiro pa&amp;iacute;s para onde ser&amp;aacute; exportado aquele que ficou conhecido como o computador portugu&amp;ecirc;s mas, de acordo com Jo&amp;atilde;o Paulo S&amp;aacute; Couto, &amp;laquo;as entregas para o mercado internacional em nada influenciam a distribui&amp;ccedil;&amp;atilde;o em Portugal&amp;raquo;.&lt;/font&gt;&lt;/span&gt;&lt;/p&gt;&lt;p style="margin:0cm 0cm 6pt;text-align:justify;"&gt;&lt;span style="font-family:Arial;"&gt;&lt;font size="3"&gt;O respons&amp;aacute;vel escusa-se, no entanto, a apontar o respons&amp;aacute;vel pela falha da entrega dos Magalh&amp;atilde;es e garante que todos os alunos do primeiro ciclo recebem o Magalh&amp;atilde;es &amp;laquo;at&amp;eacute; ao final de Mar&amp;ccedil;o&amp;raquo;.
